Constitution Day, also known as Samvidhan Divas, is a significant occasion in India celebrated on November 26th each year. This day holds great importance as it commemorates the adoption of the Constitution of India in 1949. It officially came into effect on January 26, 1950, marking the birth of the Republic of India. On Constitution Day 2023, it is essential for every Indian citizen to be familiar with their basic rights and the fundamental laws that govern the nation.

In 2015, Prime Minister Narendra Modi announced that 26th November would be observed as Constitution Day in India. The year 2015 marks the 125th birth anniversary of Dr. B.R. Ambedkar who is popularly known as the Father of the Constitution of India. It is a tribute to the huge legacy left behind by Dr. B.R. Ambedkar.

Constitution Day also signifies the efforts to spread awareness of the values of the Constitution. It is also important to remember and follow the ideals and ideas ignited by Dr. B.R. Ambedkar in the hearts of millions of citizens of India and beyond.

As per the Indian Constitution, citizens are entitled to exercise their freedom of speech and expression, peacefully assemble, create associations or unions, move freely within the Indian territory, reside and settle in any part of the country, and pursue any profession, occupation, trade or business of their choice.

In India, individuals have the legal right to file a First Information Report (FIR) at a police station, and no police officer is allowed to refuse to register it. This right is safeguarded by Section 166 of the Indian Penal Code, which addresses the punishment for a “public servant disobeying the law with the intent to cause injury to any person.” This legal provision ensures that any police officer refusing to register an FIR can face penalties, including imprisonment for up to one year, a fine, or both.

The fundamental rights granted by the Constitution ensure that every citizen enjoys certain essential freedoms. These include the right to equality, which prohibits discrimination on grounds of religion, race, caste, sex, or place of birth. The right to freedom encompasses freedom of speech and expression, freedom of assembly, and the right to practice any profession or occupation.

Constitution Day offers an opportunity to introspect and examine our collective response to the vision of the makers of our Constitution. Let us come together on this Constitution Day and resolve to realize the objectives of equality, fraternity, and liberty by exposing those who in the name of saving the Constitution have suffocated the very premise on which our Constitution stands.

In addition to understanding their rights, Indians should also be aware of their duties as responsible citizens. The Constitution emphasizes the importance of promoting harmony and the spirit of common brotherhood, transcending religious, linguistic, and regional diversities.

An essential aspect of Constitution Day is the recognition of the role of Dr. B.R. Ambedkar, the chief architect of the Indian Constitution. Indians should take inspiration from his commitment to justice and equality.
